Masterpiece Cakeshop, Jack Phillips Win Lawsuit

Jack Phillips, the owner of Masterpiece Cakeshop has been embattled with lawsuits for over a decade at this point for running a Christian bakery in Colorado. Phillips’s refusal to bake a cake for a gay wedding was the pretense for the state of Colorado to use civil rights law against him, dragging him all the way before the Supreme Court where Phillips won a narrow, procedural victory. The process was then repeated with a transvestite demanding a cake be made in celebration of their perversion which Phillips also refused.

The victory of Jack Phillips here is more procedural than substantive this time around as well. The ruling states:

How should governments balance the rights of transgender individuals to be free from discrimination in places of public accommodation with the rights of religious business owners when they are operating in the public market? We cannot answer that question however, because of a threshold issue of administrative law and statutory interpretation: Could the district court properly consider the claims of discrimination presented here? In light of this dispute’s procedural journey, it could not.

This was a clear copout by the Colorado Supreme Court which being extremely woke used the preferred pronouns of the transvestite. Essentially the ruling argues that the transvestite did not have permission from the government anti-discrimination agency to sue, therefore invalidating the lawsuit entirely. Jack Phillips initially lost in court but won at the state Supreme Court level.

Analysis

This victory is a pyrrhic one as Jack Phillips has to exhaust Christian resources to defend against civil rights government agencies who are weaponizing Social Justice using taxpayer money. These victories are not sustainable because our resources are more finite, and the procedural nature of the triumph provides no lasting precedent to deter future lawfare.
